for the sale of goods through the online store operated at marisconceptstore.com

1. Introductory Provisions

1.1. These Terms and Conditions govern the mutual rights and obligations between Maris Partners s.r.o. (the “Seller”) and any person who enters into a purchase agreement with the Seller through the online store (the “Customer”).

1.2. The online store is operated at marisconceptstore.com.

1.3. These Terms and Conditions form an integral part of the purchase agreement.

1.4. Where the Customer is a consumer, meaning a natural person who enters into an agreement with the Seller outside the scope of their business activity or independent professional activity (the “Consumer”), the applicable consumer protection laws shall apply.

2. Product Information and Prices

2.1. Information about the goods, their main characteristics and prices is provided on the individual product pages in the online store.

2.2. Product prices include all applicable taxes and charges, unless expressly stated otherwise in the online store.

2.3. Product prices do not include any applicable delivery costs. The available delivery options and related costs are displayed to the Customer during checkout before the order is completed.

2.4. The Seller reserves the right to change product prices. The price applicable to the Customer is the price displayed at the time the order is submitted, except in the case of an obvious pricing error.

2.5. If a product is displayed at a price that is clearly incorrect as a result of an obvious technical, administrative or other error, the Seller is not obliged to supply the product at that incorrect price. In such a case, the Seller will contact the Customer without undue delay and offer the Customer the option to purchase the product at the correct price or cancel the order.

3. Orders and Conclusion of the Purchase Agreement

3.1. The Customer places an order through the online store.

3.2. Before submitting the order, the Customer has the opportunity to review and amend the information entered, the contents of the shopping cart, the selected delivery and payment methods and the total price of the order.

3.3. By submitting the order, the Customer confirms that they have read these Terms and Conditions.

3.4. Upon receipt of the order, the Seller will send confirmation of its receipt to the email address provided by the Customer in the order.

3.5. The purchase agreement is concluded when the Seller sends confirmation of the order to the Customer’s email address.

3.6. Before confirming an order, the Seller may request additional confirmation from the Customer, particularly in the case of an unusual quantity of goods, an unusually high order value or other circumstances giving rise to reasonable doubts about the order.

3.7. The Seller may refuse or cancel an order, in particular if the ordered goods are unavailable or if there has been an obvious error in the price or product description. If the Customer has already paid the purchase price, the relevant amount will be refunded without undue delay.

4. Payment

4.1. The Customer may use the payment methods currently offered in the online store.

4.2. The specific payment methods available are displayed to the Customer during checkout.

4.3. In the case of cashless payment, the purchase price is deemed paid when the relevant amount is credited to the Seller or when successful payment is confirmed by the payment service provider.

5. Delivery

5.1. The Customer selects from the delivery methods currently available when placing an order.

5.2. Available delivery methods, their prices and any applicable conditions are stated in the online store and displayed to the Customer before the order is completed.

5.3. The goods will be delivered to the address or collection point selected by the Customer when placing the order.

5.4. The Seller will deliver the goods without undue delay and no later than within the statutory time limit, unless otherwise agreed with the Customer.

5.5. The Customer is responsible for providing correct and complete information required for delivery.

5.6. If a shipment is returned to the Seller for reasons attributable to the Customer, in particular because the Customer failed to accept the shipment or provided incorrect or incomplete delivery information, the Seller and the Customer may agree on reshipment. The Customer shall bear the cost of reshipment unless otherwise agreed.

5.7. Failure to accept a shipment does not in itself constitute withdrawal from the purchase agreement.

6. Receipt and Damage to Shipments

6.1. Customers are advised to check the condition of the shipment upon receipt.

6.2. If the shipment is visibly damaged upon delivery, the Customer is advised to document the damage and notify the Seller as soon as possible at customercare@marisconceptstore.com.

6.3. Reporting damage immediately after receipt helps the Seller resolve the matter with the carrier but is not a condition for exercising the Customer’s statutory rights.

7. Consumer’s Right of Withdrawal

7.1. The Consumer has the right to withdraw from a purchase agreement concluded through the online store without giving any reason within 14 days from the date on which the Consumer receives the goods, unless otherwise provided by law.

7.2. Where several items forming part of one order are delivered separately, the withdrawal period begins on the date on which the Consumer receives the last item.

7.3. To meet the withdrawal deadline, it is sufficient for the Consumer to send notice of withdrawal before the withdrawal period expires.

7.4. The Consumer may notify the Seller of the withdrawal, in particular by email at customercare@marisconceptstore.com, or may use the Withdrawal Form provided below. Use of the form is not mandatory.

7.5. Merely failing to accept a shipment does not constitute withdrawal from the agreement.

7.6. The Consumer must send or hand the goods back to the Seller without undue delay and no later than 14 days after withdrawing from the agreement.

7.7. The Consumer bears the direct costs of returning the goods.

7.8. The Seller will refund all payments received from the Consumer under the agreement, including the cost of delivery, up to the amount corresponding to the least expensive standard delivery method offered by the Seller.

7.9. If the Consumer returns only part of an order, the original delivery costs will be refunded only if and to the extent that the cost of the original delivery would have been different had the Consumer retained only the remaining goods.

7.10. The Seller will make the refund without undue delay and no later than 14 days after the Consumer withdraws from the agreement. However, the Seller is not required to make the refund before receiving the returned goods or before the Consumer provides evidence that the goods have been sent back, whichever occurs first.

7.11. Refunds will be made using the same payment method used by the Consumer for the original transaction, unless otherwise agreed and provided that the Consumer does not incur any additional costs as a result.

7.12. The Consumer is liable only for any diminished value of the goods resulting from handling them beyond what is necessary to establish their nature, characteristics and functionality.

8. Condition of Returned Goods and Diminished Value

8.1. The Consumer may handle the goods only to the extent necessary to establish their nature, characteristics and functionality, in a manner comparable to what would be permitted in a physical store.

8.2. If the Consumer handles the goods beyond this extent and their value is reduced as a result, the Consumer is liable to the Seller for the diminished value.

8.3. When assessing any diminished value, the Seller may take into account, in particular, the condition of the goods, the extent and manner of use, damage, soiling, missing parts or other circumstances affecting the possibility of reselling the goods.

8.4. The Seller may set off a claim for diminished value of the goods against the Consumer’s claim for a refund of the purchase price.

8.5. Consumers are advised to return goods in their original packaging where possible. The absence of the original packaging does not in itself result in the loss of the right of withdrawal.

9. Exceptions to the Right of Withdrawal

9.1. The Consumer may not withdraw from the agreement in cases where the law provides an exception to the right of withdrawal.

9.2. This may apply, in particular, to goods supplied in sealed packaging which the Consumer has removed from the packaging and which are not suitable for return for health protection or hygiene reasons, provided that the statutory conditions for this exception are met.

10. Defective Goods and Complaints

10.1. The Seller is responsible to the Consumer for ensuring that the goods are free from defects upon receipt and comply with the agreed and statutory requirements.

10.2. The Consumer may exercise their statutory rights in respect of defective goods within the period provided by law.

10.3. The Consumer may submit a complaint, in particular, by email to customercare@marisconceptstore.com. The Seller may ask the Consumer to provide photographs or other reasonable information necessary to assess the complaint.

10.4. The Seller will confirm receipt of the complaint and provide the Consumer with information about its resolution in accordance with applicable law.

10.5. Complaints will be handled without undue delay and no later than 30 days from the date on which the complaint is submitted, unless the Seller and the Consumer agree on a longer period.

10.6. In the event of a defect, the Consumer has the rights provided by applicable law, including, where the relevant statutory conditions are met, the right to request that the defect be remedied by repair or replacement with goods free from defects, or to request an appropriate reduction in the purchase price or withdraw from the agreement.

10.7. In the case of a justified complaint, the Consumer is entitled to reimbursement of reasonably incurred costs associated with making the complaint in accordance with applicable law.

10.8. The Consumer must provide the Seller with reasonable cooperation necessary to assess and resolve the complaint.

10.9. Goods sent in connection with a complaint should be appropriately packaged to prevent further damage during transport.

10.10. Original packaging is not required in order to make a complaint.

11. Personal Data Protection

11.1. Information about the processing of Customers’ personal data is provided in the separate Privacy Policy available in the online store.

12. Alternative Dispute Resolution

12.1. If a consumer dispute arises between the Seller and the Consumer and cannot be resolved by mutual agreement, the Consumer may submit a proposal for alternative dispute resolution.

12.2. The competent alternative dispute resolution body is:

Czech Trade Inspection Authority
Central Inspectorate – ADR Department
Gorazdova 1969/24
120 00 Prague 2
Czech Republic
email: adr@coi.gov.cz

12.3. Further information about alternative dispute resolution is available on the website of the Czech Trade Inspection Authority: coi.gov.cz/informace-o-adr/

13. Final Provisions

13.1. Legal relations between the Seller and the Customer are governed by the laws of the Czech Republic. This does not affect the Consumer’s rights arising from mandatory provisions of applicable law.

13.2. If any provision of these Terms and Conditions is invalid or ineffective, this does not affect the validity of the remaining provisions.

13.3. The Seller may amend these Terms and Conditions. The version of the Terms and Conditions in effect at the time the relevant purchase agreement is concluded applies to that agreement.

13.4. The purchase agreement may be concluded in Czech or English according to the language version of the online store used when placing the order.

13.5. The purchase agreement and these Terms and Conditions are stored by the Seller electronically for the period required by applicable law.

These Terms and Conditions are effective from 17 September 2026.
